1 What happens legally when an off-plan real estate project in Dubai is officially cancelled?

When a project is officially cancelled by the Real Estate Regulatory Agency (RERA), the liquidation and refund process is referred to the Special Judicial Committee for Incomplete and Cancelled Real Estate Projects in the Emirate of Dubai (established under Decree No. (33) of 2020). This specialized committee is solely responsible for auditing the project's escrow account, liquidating assets, and distributing the remaining funds to registered investors

2 Can I file a standard lawsuit in the Dubai Courts to get my money back?

Under Dubai law, standard civil and commercial courts do not have jurisdiction over cancelled or incomplete off-plan projects . The Special Judicial Committee holds exclusive authority over these disputes . Any standard lawsuit filed in the regular courts regarding a cancelled project will be dismissed for lack of jurisdiction, making it mandatory to file your claim directly with the Special Judicial Committee.

3 How are the decisions of the Special Judicial Committee enforced?

Decisions and disbursement orders issued by the Special Judicial Committee are final, binding, and carry the power of an executive deed . This means they do not require further appeals and are sent directly to the Dubai Execution Courts for immediate enforcement to distribute the revenue among registered Investors

4 I am an international investor living outside the UAE. Can I still recover my funds?

This is a critical issue that requires immediate legal intervention. If a developer failed to do so, we would raise specific claims of developer default and fraud before the Committee to hold the developer's management personally and corporately liable for your money.
